IDAHO COUNTY ORDINANCE No. 51
AN ORDINANCE OF IDAHO COUNTY, STATE OF IDAHO, AMENDING IDAHO COUNTY ORDINANCE NO. 40, WHICH CREATED THE IDAHO COUNTY AIRPORT ADVISORY BOARD; CONTINUING THE DEFINITIONS EARLIER CREATED; PROVIDING THAT AT LEAST ONE MEMBER OF THE ADVISORY BOARD BE A RESIDENT OF THE CITY OF GRANGEVILLE AND THAT PERSONS APPOINTMENT BE BASED UPON A RECOMMENDATION BY THE CITY COUNCIL TO THE BOARD OF COUNTY COMMISSIONERS; PROVIDING FOR THE RETENTION OF ORDINANCE NO. 40 EXCEPT WHERE IN CONFLICT WITH THIS AMENDMENT; PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF IDAHO COUNTY:
Section 1: Idaho County Ordinance No. 40, which provides for the creation of the Idaho County Airport Advisory Board.
Section 2: “Idaho County Airport Advisory Board” is hereby continued as created in Ordinance No. 40.
Section 3: Definitions:
a) The “Advisory Board” shall mean the Idaho County Airport Advisory Board.
b) The “Airport” shall mean the Idaho County Airport.
c) The “Airport Manager” shall mean the individual appointed by the Idaho County Commissioners as the primary person responsible to the Board of Commissioners for maintenance and operation of the Idaho County Airport.
d) The “Board of Commissioners” shall mean the Board of Idaho County Commissioners.
Section 4: Members and Terms of Office:
a) The Advisory Board shall consist of five (5) members to be appointed by the Board of Commissioners at least one of which shall be a member recommended to the Board of County Commissioners by the City Council and reside within the City of Grangeville. The Advisory Board may make recommendations to the Board of Commissioners concerning all new or replacement members. The Board of Commissioners may appoint one (1) member of the Advisory Board to represent the interests of the United States Forest Service on the Advisory Board.
b) Each member of the Advisory Board shall serve at the will and pleasure of the Board of Commissioners, provided however, that unless sooner terminated the term of office for members shall be as follows: Three (3) members shall be appointed for a term of 3 years and two (2) members shall be appointed for a term of 2 years. (The initial City of Grangeville member shall be appointed to fill any existing vacancy and then the Grangeville position shall rotate as described in this section.)
c) Members of the Advisory Board shall be classified as “volunteers” and shall not be entitled to compensation for their service. Members of the Advisory Board shall not be entitled to reimbursement for expenses incurred by reason of their service unless prior written approval of the Board of Commissioners is obtained.
Section 5: Advisory Board Meetings:
a) The Advisory Board shall hold one (1) regular meeting per month in a public location. The date and time of said meetings shall be established by the Advisory Board. All meetings shall be open to the public and shall be held in compliance with Idaho’s Open Meetings Laws. The Advisory board may adopt internal rules for orderly conduct of meetings.
b) A quorum shall be a majority of the Advisory Board. All recommendations and actions shall be made by a majority vote of a quorum of the Advisory Board.
c) The Advisory Board shall elect a chairperson and secretary from its members annually during the January meeting. The chairperson shall be responsible for conduct of meetings and communications with the Board of Commissioners and the Airport Manager. The secretary shall be responsible for preparing meeting minutes, providing notification of meetings and preparing and disseminating general correspondence for the Board. The secretary shall also keep, maintain and safeguard all records and documents pertaining to the Advisory Board until otherwise advised by the Board of Commissioners.
Section 6: Duties of Advisory Board:
a) The Advisory Board’s duties shall be advisory only. The Advisory Board and its members shall have no powers or authority to contract, incur any liability or expense on behalf of Idaho County, to supervise or direct airport management or operations or to make or enforce any laws or regulations.
b) The Idaho County Airport Advisory Board shall review and make recommendations to the Board of Commissioners on matters pertaining to the management, operation and development of the airport, including but not limited to:
Identifying problems involving airport safety, compliance with FAA regulations and other airport policies and recommending solutions; and
Reviewing the Airport Master Plan and making recommendations for the development, improvement and promotion of the airport and for funding sources; and
Reviewing lease requests and making recommendations prior to consideration by the Board of Commissioners; and
Reviewing airport fees and lease rates and making recommendations for changes; and
Receiving comments from members of the public concerning the airport and communicating the same to the Board of Commissioners.
Section 7: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 8: This amending ordinance shall become effective upon its passage, approval, and publication in the Idaho County Free Press.
