 9:45 a.m. The board convened with Commissioners Skip Brandt, Mark Frei and Denis Duman and Kathy Ackerman, Clerk present.

The meeting opened with the Pledge of Allegiance.

Parson Rayphe offers an opening prayer.

9:45 a.m. Discussion regarding MOU between Noxious Weeds and Clearwater RC & D-Connie Jensen-Blyth is ill today, has sent the revised MOU to Ackerman. This will be tabled pending final review by Kirk MacGregor later this morning.

Brandt moves to amend the agenda to include a discussion regarding a possible emergency declaration at 10:50 a.m. and an Executive Session for legal at 11:15 a.m. Frei seconds. Motion carries with all in favor.

10:00 a.m. Canvass of votes for March 14 Election-Frei moves to approve the canvass of the March 14 Election. Duman seconds. Motion carries with all in favor.

10:30 a.m. Frei moves to approve the minutes of the March 14 meeting. Duman seconds. Motion carries with all in favor.

10:32 a.m. Duman reads Fair Housing Proclamation for 2017 aloud. Duman moves to adopt Proclamation. Brandt seconds. Motion carries with all in favor.

10:35 a.m. Brandt moves to go into Indigent proceedings pursuant to Idaho Code 31-874. Duman seconds. Roll call-District 1-yes; District 2-yes; District 3-yes

10:50 a.m. End Indigent

Brandt moves to approve the additional meeting payment requests for Duman and Brandt. Duman seconds. Motion carries with all in favor.

Brandt moves to approve the Certificates of Residency for Michael Told and Carson Morrow. Frei seconds. Motion carries with all in favor.

Brandt moves to approve the employee changes per Kathy Ackerman. Duman seconds. Motion carries with all in favor.

11:04 a.m. Gene Meinen regarding possibility of declaring a disaster-several slides over the weekend in various areas-one area, Big Cedar, has seen recurring slide activities even after putting thousands of dollars in to stabilize it. Meinen advises that he has started discussions with Kevin Tomlinson, Bennett Forest Industries, about the possibility of trading an easement in order to allow for the construction of a new road. Zumalt advises that disaster grant funding may be available for temporary repairs, but not permanent repairs-discussion. Brandt questions the length of the stretch requiring repair-Meinen advises that it’s about 9/10 of a mile-6/10 for the shorter repair. Zumalt advises that the assistance would not be available to private citizens. Discussion regarding road into Village 21 Subdivision. MacGregor advises that he feels it is in the interest of public safety to put up barriers to close the road-discussion regarding whether the County has jurisdiction over the road. Commission directs Meinen to loan some cones and signs to serve as a barrier, as per the request of the homeowners in the area. Zumalt will check on entering the creek to divert debris-Cook recommends taking photos to document current situation. Zumalt advises that in order to do a declaration, he needs some specifics as to what areas to include and also the timeframe for work to commence. Brandt moves to declare a disaster. Duman seconds. Motion carries with all in favor. Zumalt will get the paperwork together for signature.

12:00 p.m. Brandt moves to go into Executive Session pursuant to 74-206(1)(f) for legal. Frei seconds. Roll call-District 1-yes; District 2-yes; District 3-yes

12:33 p.m. End Executive Session

Frei questions whether or not MOSS attendance could be covered for Sts. Peter & Paul and Summit Academy students-Brandt advises we have not been approached by either school-will consider requests.

Duman questions the status of the Joint Powers Agreement for the Adams County Landfill-questions whether or not other counties are moving forward. Brandt advises that until there is a solid financial commitment, the agreement and Articles of Organization are in a holding pattern. Brandt advises that the site certification has been done-other pieces need to come together-advises that Greg Johnson is working with his PA to iron out the details.   Duman will follow up on this.

Brandt moves to approve the MOU for Noxious Weeds. Frei seconds. Motion carries with Brandt and Frei in favor. Duman abstains-conflict.
