DECEMBER SESSION                                      December 3, 2013                              FIRST TERM DAY

 

9:45 a.m. The board convened with Commissioners James Rockwell and Skip Brandt, and Kathy Ackerman, Clerk present.  Commissioner Jim Chmelik is absent.

 

The meeting opened with the Pledge of Allegiance.

 

9:45 a.m.  SRS Resolution discussion. Rockwell moves to approve resolution.  Brandt seconds.  Motion carries with Rockwell and Brandt in favor.  Chmelik is absent.

 

10:07 a.m. Mike Mager with Grangeville Rural Fire Protection District regarding annexation of parcels into the district.  They received petitions, published hearing notices and held public hearings on the annexation-requests an order from Commission as required by Idaho Code.  Discussion.  Rockwell moves to approve Orders of Annexation as presented for Truman Hill, Patrick & Randi Finney, Marilyn Rylaarsdam-Schoo, William & Carla Carpenter, Bob Rylaarsdam, Rylaarsdam Family Trust, Richard & Rebecca Workman, and Joseph & Tova Cladouhos.  Brandt seconds. Motion carries with Rockwell and Brandt in favor.  Chmelik is absent.

 

Brandt moves to approve the minutes of the November 26 meeting.  Rockwell seconds. Motion carries with Rockwell and Brandt in favor.  Chmelik is absent.

 

Brandt moves to approve Clearwater Management Council dues of $2400.  Rockwell seconds. Motion carries with Rockwell and Brandt in favor.  Chmelik is absent.

 

10:15 a.m. Deanna Hall regarding Jay Exum request for cancellation of taxes-she has spoken with him and he is going to pay. Hall regarding Diane Probert request for cancellation of taxes-discussion-Hall feels this should be paid.  Brandt moves to deny request/retain taxes as per the recommendation of Hall.  Rockwell seconds. Motion carries with Rockwell and Brandt in favor.  Chmelik is absent.

 

James Zehner regarding Jeff and Pam Stout-error occurred with a postal address notification from USPS- they changed the address back to the previous New Hampshire address, which caused the Stouts to lose their homeowners exemption-Zehner recommends cancellation of $389.60.  Brandt moves to cancel additional taxes.  Rockwell seconds. Motion carries with Rockwell and Brandt in favor.  Chmelik is absent.

 

10:30 a.m. Mike Ayers regarding mining claim and the assessment of the solid waste fee on his claim near Golden-wants to know what authority we have to assess the solid waste fees-requests cancellation-discussion.  Also advises that he feels the Assessor’s office is trespassing-requests a letter in advance.  Zehner advises that he told Mr. Ayers that the solid waste fees are not in Idaho Code under the Assessor’s duties, but that it is in code that the County is required to provide the framework for assessing the fees and this is done through our county ordinance-discussion.  Regarding trespassing, Zehner advises that if they have a note in the file, they do make arrangements to contact the owner first.  Discussion regarding trespassing-Ayers advises that we are officially notified not to trespass on his property or he will make a citizen’s arrest.

 

10:45 a.m. James Zehner regarding the implementation of solid waste fees in 2008-all small business solid waste fees were moved to the personal property tax rolls-now that the personal property tax exemption is in place, there is an issue because those personal property tax accounts no longer exist-wonders if the solid waste fees should be returned to the real property roll-discussion.  Zehner requests that the Commission consider this for a couple of weeks and then we come back for a workshop to address these issues.  Continued to December 17 at 1 pm to discuss solid waste fees, permanent ‘campsites’, personal property exemptions, ag solid waste. Zehner will contact Kirk MacGregor to make sure he can attend.

 

11:05 a.m. Ackerman requests early closure of the Courthouse on Christmas Eve at 1 pm and New Year’s Eve at 3 pm.  Commission has no objection.

 

11:15 a.m. Zehner regarding quit claim deed from Mr. Reynold Allgood, which we have had since February.  Brian Hewson from the Idaho County Sheriff’s Office provides background on the home and property-advises that he checked with the Nez Perce Tribe and they advised that it was not owned by the Tribe-Hewson then followed up with the Bureau of Indian Affairs in Portland, who provided him with a map, which shows an overlay of tribal property-discussion regarding possible pending federal litigation.  Ackerman questions whether or not the quit claim should be recorded now or after MacGregor has researched the federal case law-Commission advises to record the document and then have MacGregor follow up.  Ackerman questions recording fee waiver-Commission advises to waive the fees.  Zehner will let Mr. Allgood know the deed has been recorded.

 

11:30 a.m. Mike Cook regarding letter to BLM regarding the Notice of Non-Compliance-this was sent to Chmelik-he advised that he would contact Cook if he had any changes and Cook has not heard back from him-discussion.  Letter signed.

 

11:47 a.m.  Rockwell moves to go into Indigent proceedings pursuant to IC 31-874.  Brandt seconds. Roll call-District 1- yes, District 2-yes, District 3-absent.
