IDAHO COUNTY ORDINANCE NO. 41
AN ORDNANCE OF IDAHO COUNTY, IDAHO, AMENDING SECTION 10 OF IDAHO COUNTY ORDINANCE NO. 34 PERTAINING TO THE GRANGEVILLE AREA OF CITY IMPACT; CLARIFYING AND PROVIDING THAT AMENDMENTS TO ANY GRANGEVILLE CITY ORDINANCES, THE CITY OF GRANGEVILLE COMPREHENSIVE PLAN AND CHANGES TO ZONING CLASSIFICATIONS FOR PROPERTIES WITHIN THE AREA OF CITY IMPACT MADE AFTER APRIL 24, 1995, SHALL NOT BE ENFORCEABLE OR AFFECT PROPERTY WITHIN THE GRANGEVILLE AREA OF CITY IMPACT UNLESS ADOPTED SEPARATELY BY COUNTY ORDINANCE; PROVIDING THAT CHANGES TO ZONING CLASSIFICATIONS OF PROPERTY WITHIN THE CITY LIMITS AFTER APRIL 24, 1995, SHALL NOT AFFECT OR CHANGE ZONING CLASSIFICATIONS OF PROPERTY WITHIN THE GRANGEVILLE AREA A CITY IMPACT EXCEPT AS OTHERWISE MAY BE PROVIDED BY SEPARATE COUNTY ORDINANCE; PROVIDING THAT ALL ORDINANCES AND PARTS THEREOF IN CONFLICT WITH THE ORDINANCE ARE REPEALED PROVIDING THAT THE ORDINANCE SHALL BE AN EFFECTIVE UPON BOTH A) HEARING, APPROVAL AND PUBLICATION BY THE BOARD OF IDAHO COUNTY COMMISSIONERS AND B) HEARING, APPROVAL AND PUBLICATION BY THE CITY OF GRANGEVILLE AS PROVIDED BY LAW.
WHEREAS, the Idaho County Commissioners believe is the best interest of the County and its residents to adopt the following amendments to Idaho County Ordinance No. 34 to clarifying that planning and zoning decisions within the Grangeville area of city impact require the approval of the Board of Idaho County Commissioners to be effective following such notices and hearings as are required by law under title 67, chapter 65 of the Idaho County; and
WHEREAS, the City Council of the City of Grangeville has agreed to amendment of city event Pact ordinance is provided hereafter; and
Now, therefore, be it ordained by the Board of Commissioners of Idaho County, State of Idaho:
SECTION 1: Section 10 of Idaho County Ordinance no. 34 is hereby amended and shall henceforth provide as follows:
Section 10: Amendments to any Grangeville city ordinances and the City of Grangeville Comprehensive Plan made after April 24, 1995, shall not be enforceable or affect any property within the area city impact less separately adopted by ordinance of the Board of Idaho County Commissioners. No change in zoning classification for any property within the area of impact after April 24, 1995, shall be effective or enforceable unless separately approved and adopted by ordinance of the Board of Idaho County Commissioners
Changes to zoning classifications of property within the city limits of the City of Grangeville shall not affect or change the zoning classification of any property within the area of city impact except as may be approved and adopted by separate ordinance of the Board of Idaho County Commissioners.
Nothing herein shall prevent the City of Grangeville Road from amending any of its ordinances or comprehensive plan for effect within the city limits, or changing zoning designations of property within the city limits without the consent of the Board of Idaho County commissioners.
SECTION 2: Any ordinance or portion thereof in conflict with this ordinance is hereby repealed.
SECTION 3: This ordinance shall be effective upon both a) hearing, approval and publication by the board of Idaho County Commissioners and b) hearing, approval, passage and first publication by the city of Grangeville as provided by law.
