IDAHO COUNTY ORDINACE NO. 14

AN ORDINANCE PROVIDING A MEANS FOR DIRECT LEGISLATION OF THE PEOPLE OF IDAHO COUNTY, IDAHO, BY MEANS OF INITIATIVE AND REFERENDUM; PROVIDING FOR THE PERCENTAGE OF QUALIFIED VOTERS SIGNING SUCH PETITIONS; PROVIDING FOR THE TIME OF ELECTIONS AT TIMES OF OTHER GENERAL OR PRIMARY ELECTIONS WITHIN NINETY DAYS; ADOPTING REQUIREMENTS FOR SIGNATURE PURSUANT TO IDAHO CODE; PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL AND PUBLICATION.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF IDAHO COUNTY, IDAHO, AS FOLLOWS:
1. There is hereby established a procedure for the filing of petitions for direct legislation by the people through the means of initiative and referendum in Idaho County, Idaho. A petition for initiative or referendum shall substantially comply in form for requirements of signature, verification of valid petitions and printing of petitions with Idaho Code herewith, are hereby adopted by this reference. The Clerk of Idaho County, Idaho, shall keep three (3) copies of such selections on file in his office in the Idaho County Courthouse.
In addition, to the requirements of forms set out above, before any initiative or referendum shall be placed upon any election ballot, there shall be affixed thereto the signatures of petitioners equal in number to twenty percent (20%) of the total number of voters registered to vote at the last general election in the County.
2. No petition for referendum may be filed unless more that sixty (60) days have expired following the final adoption of the County ordinance to be subject to such referendum.
3. In the event that there is no general or primary election scheduled within ninety (90) days of the final certification of the petition for initiative or referendum then not more than ninety (90) days following such certification a special election on such initiative or referendum shall be provided for. However, in the event that a primary or general election will follow within ninety (90) days of the final certification of the petition, then such initiative or referendum will be submitted at the time of the said general or primary election.
Notwithstanding the other provisions of Idaho Code section 34-1701 through 34-1705, the Idaho County Clerk shall have ten (20) days from the date of the filing of any petition to make certification to its correctness. (Amended to 10 days in Ordinance 44)
