ORDINANCE NO. 11
AN ORDINANCE PROVIDING FOR AN ALTERNATIVE TO PAYMENT OF CASH TO COUNTY EMPLOYEES FOR OVERTIME HOURS WORKED; PROVIDING FOR COMPENSATION IN THE FORM OF COMPENSATORY TIME FOR SUCH OVER-TIME WORK; PROVIDING FOR THE LIMITS WITHIN WHICH COMPENSATORY TIME MUST BE TAKEN; PROVIDING FOR A SCHEDULE RELATING TO COMPENSATORY TIME PROVIDING FOR ACCUMULATION OF COMPENSATORY TIME; PROVIDING FOR TIME OFF IN LIEU OF WORKING ON HOLIDAYS; AND ESTABLISHING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF IDAHO COUNTY, IDAHO:
Section 1: Each officer in charge of departments within Idaho Countyshall provide compensation for overtime work; provided, however, as an alternative to providing compensation for overtime work, such officers may provide compensatory time for such overtime work in an individual employee’s normal work week, in lieu of cash compensation.
Section 2: Compensatory time which has been earned, but not taken, within six (6) months of the time it was earned, shall be paid in cash compensation.
Section 3: The amount of compensatory time granted shall be as follows:
Up to and including 40 hours per week…..Straight time.
41 hours per week and over ……………….. At the rate of 1-1/2 the straight time rate.
(Example: If one hour is worked, compensatory time will be allowed at the rate of 1-1/2 hours.)
Accumulated compensatory time may be taken by the employee at the discretion of the officer of the department.
Section 4: Straight time shall be allowed in those instances where an employee has been required to perform his or her duties on a holiday. Officers of the departments may grant another day off for employees in such case, if they are required to work holidays.
Section 5: In the event that a holiday occurs on a Saturday, the preceding Friday shall be granted, and if the holiday falls on a Sunday, the following Monday shall he granted for compensatory purposes.
Section 6: The above provisions shall affect only the offices on the current expense budget, with the exception of the Idaho County Sheriff’s Department, which is subject to special regulations.
The foregoing ordinance shall be in full force and effect upon its passage, approval and publication.
Such ordinance was duly enacted at a regular session of the Board of County Commissioners of Idaho County, held in the Commissioners’ room of the Idaho County Courthouse on the 26th day of, 1976, with all Commissioners present.
