AUGUST SESSION    AUGUST 2, 2022                FIRST TERM DAY

 9:00 a.m. The board convened with Commissioners Skip Brandt and Denis Duman and Kathy Ackerman, Clerk present.  Commissioner Ted Lindsley is absent.

The meeting opened with the Pledge of Allegiance.

Commissioner Duman offered an opening prayer.

John Wiltse provides proposal for new contract for Public Defense-advises that per the Public Defense Commission, Idaho County is at a point where a two-attorney model is needed due to the points system. Discussion regarding proposed increases to support the two-attorney model.  Total new budget proposal is $275,800.  Wiltse will work on new contract language with Jessup.

9:30 a.m. Brandt regarding bid opening for fire mitigation projects-only one bid received from Rad Mulching.  Wasem-$18,200, no piles; Taylor-$87,500, no piles. Bids will be routed to Sandi Paul for review before award.

9:45 a.m. Jessup regarding contract for Architectural Services-this is a standard agreement that he has reviewed-questions one section regarding compensation-discussion.  Duman advises that it is his understanding that additional services such as line location, delineated on Exhibit A, are charged separately per the schedule on Exhibit B.  Discussion regarding the length of the project in relation to the length of the contract.  Duman will contact them for clarification.

10:00 a.m. Brandt regarding solid waste fees and the need to increase fees to cover costs-discussion.

10:15 a.m. Brian DeVeney regarding shared well agreement on Lot 13 and designation on plat-questions whether or not an agreement can be made without amending the plat-discussion.  Jessup advises that he feels the agreement could be made without modifying the plat-will double check the subdivision ordinance and get back to Mr. DeVeney.

10:30 a.m. Solid waste fee discussion resumes-Duman moves to go forward with a proposed 25% fee increase.  Brandt seconds.  Motion carries with Duman and Brandt in favor.  Lindsley is absent.  Ackerman will set for hearing and publish a hearing notice for public comment.

11:00 a.m. Kirk MacGregor regarding request for secretary-discussion regarding whether or not this should be in Executive Session.  Brandt moves to amend the agenda to include an Executive Session at 11:03.  Duman seconds.  Motion carries with Duman and Brandt in favor.  Lindsley is absent.

11:03 a.m. Brandt moves to go into Executive Session pursuant to Idaho Code 74-206(1) b for Personnel.  Duman seconds.  Roll call-District 1-yes; District 2-absent; District 3-yes

11:20 a.m. End Executive Session

11:21 Duman advises that he would like to move forward with the contract with CRA for Architecture Services with the change in contract terms to 36 months.  Duman contacts CRA via phone for clarification.  Duman moves to approve the contract with changes.  Brandt seconds.  Motion carries with Brandt and Duman in favor.  Lindsley is absent.   Duman will have an updated contract sent.  Signature page is signed. Once changes have been reviewed and confirmed by Jessup, the entire agreement will be sent for full execution.

11:31 a.m. Budget discussion resumes. Ackerman will update the final numbers in light of the Public Defender new contract proposal and have a final version ready for next week.

11:37 a.m. Brandt moves to approve the minutes of July 26.  Duman seconds.  Motion carries with Brandt and Duman in favor.  Lindsley is absent.

Brandt moves to approve the Order for Cancelation as per Abbie Hudson.  Duman seconds.  Motion carries with Brandt and Duman in favor.  Lindsley is absent.

Brandt moves to approve the hiring of David Balken in the Jail. Duman seconds.  Motion carries with Brandt and Duman in favor.  Lindsley is absent.

Brandt moves to approve the Additional Meeting Requests for Duman for Riggins Solid Waste and Lucile Bridge FLAP and Brandt for CBC.  Duman seconds.  Motion carries with Brandt and Duman in favor.  Lindsley is absent.
