IDAHO COUNTY ORDINANCE NO. 44
AN ORDINANCE OF THE COUNTY OF IDAHO, STATE OF IDAHO, AMENDING IDAHO COUNTY ORDINANCE NO. 14 PERTAINING TO COUNTY INITIATIVE AND REFERENDUM PETITION; AMENDING STATUTORY REFERENCES, REQUIREMENTS AND PROCEDURES RELATING TO COUNTY INITIATIVE AND REFERENDUM PETITIONS TO CONFIRM TO IDAHO CODE § 31-717; PROVIDING TIME LIMITS FOR VERIFICATION OF SIGNATURES BY CLERK; PROVIDING THAT ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE ARE HEREBY REPELLED; PROVIDING FOR EFFECTIVE DATE OF THE ORDINANCE.
WHEREAS, the Board of Idaho County commissioners adopted Idaho County Ordinance No. 14, pertaining to County initiative and referendum petition in 1978, and since adoption of said ordinance certain amendments were made to the Idaho code provision pertaining to County initiative and referendum ordinance; and
WHEREAS, by reason of said amendments to the Idaho Code, changes to Idaho County Ordinance No. 14 are necessary to make the same conform to the Idaho Code,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS, IDAHO COUNTY, STATE OF IDAHO:
SECTION 1: Idaho County ordinance No. 14 is hereby modified and shall henceforth provide, in its entirety, as follows:
1.          There is hereby established the procedure for the filing of petitions direct legislation by the people through the means of initiative and referendum of Idaho County, Idaho. A petition for initiative or referendum shall comply with requirements and procedures set forth in Idaho Code § 31-717, as amended.
2.          Upon filing of a petition of initiative or referendum, the clerk and prosecuting attorney shall comply with the procedures set forth in Idaho Code § 31-717, as amended, with regard to processing the petition and any election thereon.
3.          Notwithstanding any other provision of the Idaho Code, the Idaho County Clerk shall have ten (10) working days following the receipt of any petition, or part thereof, to verify signatures thereon. At the expiration of such time the Clerk shall attach his certificate there to as provided by section 2 of the ordinance, and shall deliver the petition, with certificate attached, to the person filling the petition. A copy of each petition and certificate shall be retained by the Clerk.
SECTION 2: All ordinances, and parts thereof, in conflict with this ordinance are hereby repelled.
SECTION 3: This ordinance shall be effective upon adoption and publication as provided by law.
