DECEMBER SESSION                                      December 15, 2015                SECOND TERM DAY

 

1:00 p.m. The board convened with Commissioners Jim Chmelik, Mark Frei and Skip Brandt, and Kathy Ackerman Clerk present.

 

The meeting opened with the Pledge of Allegiance.

 

Brandt moves to approve the minutes of the December 8 meeting. Chmelik seconds.  Motion carries with all in favor.

 

1:10 p.m. Wes Hoyt regarding FRTA easement-he has been in touch with David Claiborne. Margaret McVicker has made contact with someone who specializes in historic roads-they have located an old map from the late 1880’s drawn by the Army Corp of Engineers-advises that the road in question is a branch of the Elk City Wagon Road. Discussion regarding amendments of draft agreement.  Draft will be further reviewed this week-rescheduled for 10 am next week.

 

1:42 p.m. Doug Giddings regarding situation in the jail-they are continually over the limit of 11 in custody-this is creating issues with people who are sentenced to serve weekends, as they never have room going into the weekend. Giddings asks Commission for ideas and input-will be coming back at some point in the future to discuss possible solutions.  Commission asks Giddings to speak with Judge FitzMaurice regarding the possibility of ordering defendants to report to jail in other counties and to gather more information on fees and collection of fees.  Discussion will be continued next week at 10:45.

 

1:57 p.m. Skip Brandt regarding hardship exemption guidelines-discussion regarding property value limitation.  Zehner advises that the property value threshold is $50,000.  Discussion regarding whether or not the Commission will entertain requests for hardship exemptions on ag property.  Commission will make no changes at this time.

 

James Zehner regarding property that was sold to Idaho Fish & Game-they are requesting cancellation of taxes since they are a State agency-they will continue to pay the solid waste fee-discussion. Commission has no objection to cancellation.

 

2:15 p.m. Brandt regarding Resource Plan-questions whether or not we have any copies of plans from other counties-Chmelik advises that he only received one-will forward it on. Frei advises that he will have a draft umbrella plan ready for discussion-continued to January 5 at 1 pm.

 

2:25 p.m. Mike Cook regarding latest communication with Western Federal Lands pertaining to the Salmon River Road-still working toward a resolution that would keep this out of Court-provides proposal that would commit federal funds to ITD with a designation for specific projects-amount proposed is approximately $570,000. Meinen advises that this amount could be potentially spent in one area-discussion regarding which projects on the road would be addressed via a priority list.  Discussion regarding the merits of pursuing litigation versus taking this funding and moving on.  Brandt moves to support the proposal presented by Cook from Western Federal Lands Highway Division contingent on an acceptable agreement.  Chmelik seconds. Motion carries with all in favor.  Commission advises Cook to move forward on this.

 

2:50 p.m. Kirk MacGregor regarding Baldwin Springs Road-has been advised that Mel McLean’s attorney is no longer representing him-we will have to work directly with Mr. McLean. Discussion regarding abandonment of the road.  MacGregor advises that there was an easement granted by JD Schwab to McLean. Judge Stegner ruled that the easement doesn’t exist because McLean didn’t accept it.  MacGregor has a termination agreement prepared, but McLean refused to sign.  MacGregor will follow up with Mr. McLean and then on to Judge Gaskill if Mr. McLean is unresponsive.

 

3:02 p.m. Chmelik moves to approve amended Airport Ground Lease for Rick Ross.  Brandt seconds.  Motion carries with all in favor.

 

Chmelik moves to approve wage increase for Assessor’s Office Appraiser Rob Finnell to $15.58 for successful completion of probation. Frei seconds.  Motion carries with all in favor.

 

Chmelik moves to approve Liquor Catering Permit for Shore Lodge at Burgdorf on December 30, 2015. Frei seconds.  Motion carries with all in favor.

 

Chmelik moves to approve Liquor Catering Permit for Doreen Ash for Greencreek Hall on January 16, 2016. Brandt seconds.  Motion carries with all in favor.

 

Chmelik moves to approve Orders for Cancellation as presented by Abbie Hudson-$68.08; $104.34; $1092.96. Brandt seconds.  Motion carries with all in favor.

 

Chmelik moves to approve the donation of vacation time from various County employees to Shawna Hilbert for bereavement leave as presented. Frei seconds. Motion carries with all in favor.

 

Chmelik moves to approve Bureau of Homeland Notice of Grant Adjustment. Frei seconds.  Motion carries with all in favor.

 

Chmelik moves to approve Alcoholic Beverage License for Cash & Carry Foods-Beer and Wine; and Hong Fa-Beer and Wine. Brandt seconds.  Motion carries with all in favor.

 

3:05 a.m. Chmelik moves to go into Indigent proceedings pursuant to Idaho Code 31-874. Frei seconds.  Roll call-District 1-yes; District 2-yes; District 3-yes

3:30 p.m. James Zehner regarding a purchase of 40 acres of property by Kidder Harris Highway District from Hendren. Brandt moves to exempt property.  Chmelik seconds.  Motion carries with all in favor.
