49. Inspection System Relating to the Conversion of Manufactured Housing

IDAHO COUNTY ORDINANCE NO. 49
AN ORDINANCE OF IDAHO COUNTY, STATE OF IDAHO, PROVIDING FOR ADOPTING AN INSPECTION SYSTEM RELATING TO THE CONVERSION OF MANUFACTURED HOUSING TO REAL PROPERTY PURSUANT TO THE PROVISIONS OTHER IDAHO CODES; PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF IDAHO COUNTY:
In order to provide the residents of rural Idaho County, Idaho, outside of the incorporated limits of the various cities within the county with the ready, competent, system for inspection of mobile homes or manufactured housing which owners desire to declare real estate, the county adopts the following inspection system:
Section 1:         Pursuant to the provisions of Idaho Code §63-304, the Idaho County Commission shall approve by resolution or motion one or more Idaho State Certified Building Inspectors to review applications through the Idaho Counties Assessor’s Office for persons wishing to convert manufactured homes or mobile homes to real estate. Therefore, upon the receipt of an application by the Idaho County Assessor’s Office for someone desiring to convert their mobile home or manufactured home to real estate the Idaho County Assessor’s Office shall deliver to said applicant the list of approved and certified inspectors. Thereafter, is shall be the responsibility of the applicant to contact his choice of an approved inspector, to make an inspection as soon as possible of the installed unit to determine whether the provisions of Idaho code section 44 Chapter 22 have been complied with and whether the provision which allows manufactured housing or mobile homes to become real estate under the Idaho code have been complied with.
If the chosen inspector is satisfied that all of the provisions applying to installed mobile homes have been met, said inspector shall complete an affidavit form furnished to him by the Idaho County Recorder’s Office in which affidavit the inspector will certify under oath that the unit is in compliance with the provisions of the Idaho Code and can thereafter be treated as real estate by the County Assessor and County Recorder. The applicant shall have the responsibility of paying all costs of the inspector services and have the additional affirmative duty of delivering the completed affidavit to the Idaho County Assessor’s Office.
If, however, the inspectors all willing to certify that all requirements of law have been met, he shall notify the applicant generally what construction details need to be completed so that installation might qualify as real estate in the future.
Section 2:        The approved inspector shall be authorized by this ordinance to assess and collect their inspection costs in advance of performing any inspection, if the approved inspectors choose the option of collection.
Section 3:         This ordinance shall become effective upon its passage, approval, and publication of the Idaho County Free Press.
