40. Idaho County Airport Advisory Board

IDAHO COUNTY ORDINANCE NO. 40
IN ORDINANCE TO IDAHO COUNTY, IDAHO, AND TREATING THE IDAHO COUNTY AIRPORT ADVISORY BOARD; PROVIDING DEFINITIONS FOR THE ORDINANCE; PROVIDING FOR MEMBERSHIP AND TERMS OF OFFICE; PROVIDING ADVISORY BOARD MEMBERS ARE VOLUNTEERS; PROVIDING FOR ADVISORY BOARD MEETINGS, CHAIRPERSON AND SECRETARY; PROVIDING THAT THE DUTIES OF ADVISORY BOARD ARE ADVISORY ONLY; ESTABLISHING THE DUTIES OF THE ADVISORY BOARD; PROVIDING THAT THE ORDINANCE SHALL BE EFFECTED UPON THE APPROVAL AND FIRST PUBLICATION AS PROVIDED BY LAW.
WHEREAS, the Idaho County commissioners have the general power and duty to manage county property pursuant to Idaho code §3 — 807 and have the power to operate and manage airfields pursuant to Idaho code § 21 — 401; and
WHEREAS, the Idaho County commissioners believe it is in the best interest of the county, its residents and users in Idaho County Airport to create an advisory board to abide Idaho County commissioners concerning management, operation and development of the Idaho County Airport;
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS IDAHO COUNTY, STATE OF IDAHO:
SECTION 1: The “Idaho County Airport Advisory Board” is hereby created.
SECTION 2:    Definitions:
a. The “Advisory Board” shall mean Idaho County Airport Advisory Board.
b. The “airport” shall mean the Idaho County Airport.
c. The “Airport Manager” shall mean the individual appointed by Idaho County commissioners as a primary person responsible to the board of commissioners for maintenance and operation of Idaho County Airport.
d. The “Board of Commissioners” shall mean the board Idaho County commissioners.
SECTION 3: Members and terms of Office:
a. The advisory board consist of five (5) the members, to be appointed by the board of commissioners. The advisory Board may make recommendations to the board of commissioners concerning new replacement members. Board of commissioners may appoint one (1) member of the advisory board to represent the interests and the U.S. Forest Service on the advisory board.
b. Each member of advisory Board shall serve at the will and pleasure of the board of Commissioners provided however, that unless sooner terminated the term office for members shall be as follows: Three (3) members shall be appointed for a term of 3 years and two (2) members shall be appointed for the term of 2 years.
c. Members of advisory Board shall be classified as ”volunteers” and shall not be entitled to compensation for their service. Members of advisory Board shall not be entitled to reimbursement for expensive incurred by reason of their service unless prior written approval by the Board of Commissioners is obtain
SECTION 4: Advisory Board Meetings:
a. Advising Board shall hold one (1) regular meeting per month and public location. The day and time of said meetings shall be established by the advisory board. All meeting shall be open to the public and shall be held any compliance with Idaho’s open meeting laws. Advisory board may adopt internal rules for orderly conduct of meetings.
b. A quorum shall be a majority of the Advisory Board. All recommendations and action shall be made by the majority vote of a quorum of the Advisory Board.
c. The Advisory Board shall elect a chairperson and secretary for its members. The chairperson shall be responsible for conduct of meetings and communications at the board of commissioners and Airport manager. The secretary shall be responsible for preparing meetings minutes, providing notification of meeting and preparing disseminating general correspondence for the Board. The secretaries are also keep, maintain and safeguard all records and documents pertaining to the advisory board and to otherwise advised by the board of Commissioners.
SECTION 5: Duties of Advisory Board:
a. The advisory Board’s duty shall be advisory only. Advisory Board and its members shall have no powers or authority to contract, incur any at liability or expense on behalf of the Idaho County, to supervise or direct airport management or operations in order to make or enforce any laws or regulations.
b. Idaho County Airport advisory Board shall review and make recommendations to the board of commissioners on matters pertaining to the management, operation and development of the airport, including but not limited to:
Identifying problems involving airport safety, compliance with FAA regulations and other Airport policies and recommending solutions; and
Within Airport mastermind and making recommendation for the development, improvement and promotion of the airport and were funding sources; and
Revealing airport fees and lease rates and making recommendations for changes; and
Receding comments from members of the public concerning the airport and communicating the same to the board of commissioners.
SECTION 6: This ordinance shall be effective upon approval, passage and first publication.
