39. (Amends Ord. #30) Liquor Sales

IDAHO COUNTY ORDINANCE NO. 39
AN ORDINANCE OF IDAHO COUNTY, IDAHO, AMENDING SECOND AMENDED IDAHO COUNTY ORDINANCE NUMBER 30, PERTAINING TO EXTEND SALES OF LIQUOR AND EXTENDED HOURS FOR A LIQUOR SALES; PROVIDING THAT LIQUOR BY THE DRINK, BEER AND WINE MAY BE SOLD ON SUNDAYS, THANKSGIVING DAY AND MEMORIAL DAY; AND AT PROVIDING THAT HOURS FOR LIQUOR SALES ARE EXTENDED TO 2 A.M.
WHEREAS, Idaho codes §§ 23-97, 23-1012 and 23-1332 permits communities to authorize the sale of liquor by the drink, beer and wine on Sundays, Memorial Day and on Thanksgiving Day, and to extend the hours of the sale of such alcoholic beverages until 2:00 a.m.; and
WHEREAS, the Idaho County commissioners believe it is the best interest of the county, its residents and liquor license holders to clarify the days in which liquor may be sold and of the times at which it may be sold;
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF IDAHO COUNTY, STATE OF IDAHO:
SECTON 1: Idaho County Second Amended Ordinance No. 30, is hereby amended to and shall thereafter read as follows:
SECTION 2: SUNDAY SALES SALE OF LIQUOR ON SUNDAY, THANKSGIVING DAY AND MEMORIAL DAY:
Liquor by the drink, beer and wine may be sold, offered for sale, or given a way to any license premises on Sundays, Thanksgiving Day and Memorial Day under the same rules, limitations, and conditions as apply to all other days of the week for which the sale of liquor, beer and wine is permitted by law.
SECTION 2: SECTION 3 (A) of the Idaho County second amended ordinance No. 30, is hereby amended to and shall hereafter read as follows:
SECTIONS 3: HOURS OF SALE OF LIQUOR BY THE DRINK, BEER AND WINE:
A. no liquor, beer or wine shall be sold, offered for sale, or given away upon any licensed premises, and all liquor not in sealed bottles must be locked in separate room or cabinet except during between the maximum time as provided under Idaho Code hours of 10:00 a.m. and 2:00 a.m., local time on days for which the sale of liquor by the drink beer and wine is permitted by law.
SECTION 3: The remaining portions of Idaho County second amended ordinance No. 30 unaffected by this ordinance shall remain in effect.
SECTION 4: This ordinance shall be effective upon approval, passage and first publication.
