33. Riggins Area of Impact

IDAHO COUNTY ORDINANCE NO. 33
AN ORDINANCE OF IDAHO COUNTY, STATE OF IDAHO, PASSED PURSUANT TO AUTHORITY OF IDAHO CODE § 67-6526, ADOPTING RIGGINS CITY ORDINANCE NO. 126, ESTABLISHING AN AREA OF IMPACT AROUND THE CITY OF RIGGINS.
WHEREAS, Idaho Code § 67-6526 requires the governing boards of Idaho County and the City of Riggins to adopt by ordinance, an area of city impact within the unincorporated area of the county around the City of Riggins, and plans and ordinances to be applied in such area of city impact; and,
WHEREAS, Idaho County and the City of Riggins have, pursuant to Idaho Code § 67-6526, conferred and negotiated in good faith the geographic area to be included within the area of city impact and the plans and ordinances to be applied in such area of city impact; and,
WHEREAS, Idaho County and the City of Riggins, in accordance with the procedures required by law, have mutually agreed upon an area of city impact for the unincorporated areas of Idaho County around the City of Riggins, have mutually agreed upon an area of city impact; and,
WHEREAS, pursuant to such negotiations, the City of Riggins has passed and enacted RIGGINS CITY ORDINANCE NO. 126 regarding such area of city impact; and,
WHEREAS, Idaho County and City of Riggins desire to have their ordinances read as nearly as identical to the others;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSIONERS OF IDAHO COUNTY, STATE OF IDAHO, AS FOLLOWS:
Idaho County adopts RIGGINS CITY ORDINANCE NO. 126, as IDAHO COUNTY ORDINANCE NO. 33, attached hereto as Exhibit “A”, thereby establishing an area of city impact within the unincorporated area of Idaho County around the City of Riggins, and plans and ordinances to be applied in such area of city impact.
This ordinance is enacted by Idaho County, State of Idaho on this 24day of April, 1995.

Area of City Impact Agreement for the City of Riggins, Idaho
AN ORDINANCE DEFINING AND ESTABLISHING A GEOGRAPHICAL AREA OF CITY IMPACT FOR THE CITY OF RIGGINS, IDAHO, IDENTIFYING THE COMPREHENSIVE PLAN THAT SHALL APPLY WITHIN THE ESTABLISHED AREA OF CITY IMPACT; IDENTIFYING THE SUBDIVISION AND ZONING ORDINANCES
THAT SHALL APPLY WITHIN THE ESTABLISHED AREA OF CITY IMPACT; IDENTIFYING METHODS AND PROCEDURES FOR THE APPLICATION,
ADMINISTRATION AND ENFORCEMENT OF THE COMPREHENSIVE PLAN AND ORDINANCES THAT SHALL APPLY WITHIN THE ESTABLISHED AREA OF CITY IMPACT; AND ESTABLISHING AN EFFECTIVE DATE PURSUANT TO SECTION 67-6526, IDAHO CODE.
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF RIGGINS, IDAHO, COUNTY OF IDAHO, STATE OF IDAHO, AND;
BE IT ORDAINED, BY THE BOARD OF COUNTY COMMISSIONERS, IDAHO COUNTY, STATE OF IDAHO:
Section 1. Legislative Purpose: The purpose of establishing an Area of City Impact it to identity a logical urban fringe area adjoining the City of Riggins, Idaho. The urban fringe area is realizing, or will realize, growth and development pressures that must be planned and managed in an orderly fashion. The Area of City Impact recognizes trade area, geographic factors and the delivery of public services as being associated with the City of Riggins and comprised of areas that can reasonably be expected to be annexed to the City in the near future.
Section 2. Geographic Area of impact: The officially adopted and agreed upon “Geographic Area of City Impact for Riggins, Idaho” is established by ordinance No. 126 of the City of Riggins, Idaho and Ordinance No .33 of Idaho County, Idaho and is set forth therein on the attached maps entitled   Area of City impact: dated 11-14-94.
Section 3. Comprehensive Plan: Any Comprehensive Plan and subsequent amendment thereto if officially adopted by the County of Idaho, Idaho, shall apply to the Area of City Impact within the unincorporated area of Idaho County, Idaho. The City of Riggins shall amend their Comprehensive Plan to be consistent with this agreement, if required.
Section 4. Subdivision Ordinance: The Subdivision Ordinance and subsequent amendments thereto as officially adopted by the County of Idaho, shall apply to the Area of City Impact within the unincorporated area of Idaho County, Idaho.
Section 5. Code and Ordinance Enforcement within the Area of City Impact shall be the responsibility of Idaho County with assistance provided by the City of Riggins upon request of Idaho County.
Section 6. Zoning Ordinance: Any Ordinance, Zoning Map and subsequent amendments thereto if officially adopted by Idaho County. Idaho shall apply to the Area of City impact within the unincorporated area of Idaho County. Idaho.
Section 7. Administration:
(1)      Preliminary Rats involving, property in the Area of City Impact within the unincorporated area of Idaho County, Idaho, shall require the review and approval of the Idaho County Board of
Commissioners in accordance with provisions of the Idaho County Subdivision Ordinance. Final Plats shall require review and approval by the City of Riggins prior to recordation.
(2)      The authority to enter into and execute development agreements with a subdivider and to accept required bonding or other form of security to guarantee construction or required street
improvements involving plats located in the Area of City Impact within the unincorporated Area of Idaho County, Idaho shall rest with the County of Idaho.
Section 8. Renegotiation: The Area of City Impact Agreement shall be reviewed by the City of Riggins and Idaho County at least once every five (5) years and shall be renegotiated at any time upon the request of either party hereto. Renegotiation shall begin within 30 days after written request by either City or County and shall follow procedures for the original negotiation, as set forth in Idaho Code, Section 67-6526
Section 9. Effective Date; This Ordinance shall be in full force and effect from and after its passage and publication as required by law.
