30. Liquor Sales by the Drink – Sunday Sales and Extended Hours (Amended by Ord. #39)

AN ORDINANCE EXTENDING THE HOURS OF SALE AND PERMITTING SUNDAY SALES OF LIQUOR BY THE DRINK AS PROVIDED FOR IN IDAHO CODE SECTION 23 – 927, AS AMENDED IN 1986, AND ALLOWING FOR APPROVAL BY CITY COUNCIL.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF IDAHO COUNTY, IDAHO:
SECTION 1:    This ordinance is adopted pursuant to the authority conferred by Idaho Code Section 23 – 927 as amended in 1986 which provides that a county may, by ordinance, allow the sale of liquor by the drink on Sundays, Memorial Day and Thanksgiving, and may also extend until 2 a.m. the hours of sale of liquor by the drink.
SECTION 2:    SUNDAY SALES.      Liquor by the drink may be sold, offered for sale, or given away on any licensed premises under the same rules limitations, and conditions as apply to all other days of the week.
SECTION 3:    HOURS OF SALE OF LIQUOR BY THE DRINK, BEER AND WINE.
A.        No liquor shall be sold, offered for sale, or given away upon any licensed premises, and all liquor not in sealed bottles must be locked in a separate room or cabinet during the following hours:
(1)        Christmas from 2 a.m. to 10 a.m. the following day.
(2)        On any other day between 2 a.m. and 10 a.m.
(3)        On any day of a general or primary election until the time when the polls are closed.
B.         Any patron present on the licensed premises after the sale of liquor has stopped as provided in subsection A above shall have a reasonable time, not to exceed thirty (30) minutes, to consume any beverages already served.
C.        Any person who consumes or intentionally permits the consumption of any alcoholic beverage upon licensed premises after the time provided for in subsection B above shall be guilty of a misdemeanor as defined in Idaho Code 18-111 and 18-113.
D.        It shall be the duty of every person who is employed at or upon a licensed premises or who owns or manages a licensed premises and is present upon the licensed premises during the hours and at the time set forth in subsection A of this section to lock up and keep locked up in a locked room or locked cabinet all unsealed containers of liquor during the hours and at the times set forth in subsection A of this section, and any such person who fails to perform the duty provided herein shall be guilty of a misdemeanor as defined in Idaho Code 18-111 and 18-113.
E.         This section 3 will not apply unless and until there is compliance with SECTION 4 below.
SECTION 4:    The various city council may approve the extension of hours of sale of liquor by the drink by proper action by the city council, and until such action by the city council, the provision in Section 3 will not apply to the areas within the various city limits,
