ORDINANCE OF VACATION
ORDINANCE NO. 26
AN ORDINANCE TO VACATE STREETS AND ALLEYS OF THE UNINCORPORATED TOWNSITE OF COPPERVILLE, IDAHO COUNTY, IDAHO, ACCORDING TO THE RECORDED PLAT THEREOF, WHICH WERE PREVIOUSLY DEDICATED TO THE PUBLIC; PROVIDING AUTHORITY TO THE CHAIRMAN OF THE BOARD OF IDAHO COUNTY COMMISSIONERS AND THE COUNTY CLERK TO CONVEY SUCH REAL PROPERTY TO THE ADJOINING PROPERTY OWNERS; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ; PROVIDING FOR THE ORDINANCE TO BECOME EFFECTIVE UPON ITS PASSAGE, APPROVAL AND PUBLICATION; PROVIDING PAYMENT BY PETITIONERS OF COSTS OF PUBLICATION AND RECORDATION THEREOF.
WHEREAS, those certain streets and alleyways which are listed below have never been utilized for any travel, and it is not necessary for their use for any of the citizens of Copperville, such roads and alleys have never been made into a road, nor have they been maintained by anyone, and are not necessary for public use;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF IDAHO COUNTY, IDAHO:
SECTION 1: It is hereby ordered that the following streets and alleyways of the Townsite of Copperville, Idaho County, Idaho, according to the records plat thereof, be, and the same hereby are vacated, which streets and alleyways are described more particularly as follows:
College Street: running North and South from G Street to C Street.
Alleyway: running North and South from G Street to C Street through Blocks 11, 12, 13 and 14.
State Street: running North and South from G to C Street through Blocks 7, 8, 9, and 10.
Maintain the existing County Roadbed, and vacate Main Street East and West of existing County Roadbed.
