IDAHO COUNTY BEER AND WINE ORDINANCE
ORDINANCE NO. 23
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS, IDAHO COUNTY, IDAHO, ESTABLISHING THE TIME PERIOD WITHIN WHICH A DECISION MUST BE MADE FOLLOWING SUBMISSION OF AN APPLICATION FOR A LICENSE, A TRANSFER OR RENEWAL THEREOF FOR BEER AND/OR WINE, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the Board of County Commissioners f Idaho County, Idaho.
SECTION 1: SHORT TITLE.
This ordinance shall be known as the “Idaho County Beer and Wine Ordinance,” and all other ordinances or parts of ordinances and resolutions in conflict herewith are hereby repealed upon the effective date of this ordinance upon its publication in the Idaho County Free Press.
SECTION 2: AUTHORITY AND PURPOSE.
1.      This ordinance is adopted pursuant to the authority granted by Idaho code, Sections 31-714, 31-801, 31-828, 23-1015, 21-1315.
2.      The purpose of this ordinance is to establish a time period within which a decision must be made by the Board of County Commissioners following submission of an application to them for beer and/or wine licenses, transfers or renewals.
SECTION 3: TIME LIMITS FOR BEER AND WINE APPLICATIONS.
1.      The Board of County Commissioners shall act upon an application for a beer and/or wine license or a transfer or renewal thereof at the next regularly scheduled monthly meeting of the Board of County Commissioners following the receipt of the application by the Board. In the event the Board would have scheduled the continuation of any meeting which continued meeting would occur prior to the next regularly scheduled monthly meeting the Board may act upon such application at an earlier time.
2.      The procedure for processing applications for beer and/or wine licenses and transfers or renewals shall be governed by Idaho Code, Section 23-2015, 23-1318 and any rules and regulations promulgated by the Board of County Commissioners in accordance with Title 67, Chapter 52 of the Idaho Code, the Administrative Procedure Act.
SECTION 4: EFFECTIVE DATE.
This ordinance shall be in full force and effect upon its passage approval and publication in the Idaho County Free Press.
