OCTOBER SESSION                                        October 21, 2014                   THIRD TERM DAY

 

10:30 a.m. The board convened with Commissioners James Rockwell, Skip Brandt, and Annie Bledsoe Deputy Clerk present.  Jim Chmelik was absent.

 

The meeting opened with the Pledge of Allegiance.

 

Rockwell moves to amend the agenda to discuss the Baldwin Springs Road agreement at 11:20 a.m. Brandt seconds. Motion carries with Rockwell and Brandt in favor. Chmelik absent.

 

10:35 am Kirk MacGregor reviews letter regarding Big Horse Canyon Road- Kirkpatrick, Blewett’s client, rerouted road and put a road where he wants it for his property-feels it is his road since he funded it himself. Brandt questioned if Kirkpatrick ever got permission to do any work on the public road? Meinen noted that he believes most of the road still follows the original county road. Discussion regarding issues with public access since no petition to change this road was filed. Both attorneys Blewett and Snyder would like to come in and discuss this issue with the Commissioners-set for November 4th at 10:30 a.m.

 

10:45 am MacGregor regarding proposal for engineering services-there are no specific rules on  professional services-Brandt and Rockwell advise Meinen to submit a request for proposal and hire from qualified applicants.

 

Regarding Larradon Heights Subdivision, TD& H has provided a preliminary design-the slope of the road is too steep and in order to bring it down they will have to make a two and a half foot cut, with a 12% to 14% change-discussion. Rockwell and Brandt agree that a 14% change and extending the turn out 45 feet will be good, but there will also need to be an amendment to the plat. If they don’t agree, they need to apply for a variance and come in.

 

11:00 a.m. Salmon River Road letter- Discussion

 

11:02 am Brandt moves to approve County contribution to the Clearwater RC & D of $225.00. Rockwell seconds. Motion carries with Rockwell and Brandt in favor. Chmelik absent.

 

11:15 a.m. Mike Cook regarding Airport Fuel Flowage and Lowell WUI-Mike had draft response to the Forest service. Both Randy and Jerry have contributed to what they would like to respond with-looked at maps and final payment $10,000.00 or more. Letter signed by both Brandt and Rockwell, Chmelik absent.

 

Cook also requests $5500.00 for the purchase of an ATV for spraying and pulling planes around and for maintenance at the airport. Cook believes one can find a reasonably priced used one after hunting season. There was also a 1990 Grand Caravan donated to the airport worth $500.00-$1000.00. Cook would like to sell it and add the money to the $5500.00 for the ATV.

 

Brandt moves to approve up to $6000 for a purchase of an ATV and selling of van. Rockwell seconds. Motion carries with Brandt and Rockwell in favor. Chmelik absent.

 

11:20 a.m. Baldwin Springs Road- the road access through the fence on onto John McClain’s property has been completed. There has been no set schedule for the rest of the project to be completed. Meinen thinks it is best to not start until next spring since it will not be cost effective to move equipment there at this time. If it’s not a dry winter they won’t have use of road and it will be harder to complete the project.

 

11:30 a.m. Skip Brandt regarding Stites Road issue- Idaho County no longer has any rights in the road that is located in the ravine north of Stites.  In 1949 the road was deeded to Idaho County with the stipulation from Cress that when the roadway was completed, the road rights would be returned to the owners.  The County did return the road to the Cress in 1951. Joe Wright thinks it’s a civil deal since it is vague. Rockwell thinks as commission they need to affirm that the road was deeded back to owners in 1951. Rockwell and Brandt agree that from the documentation we have before us, the commission affirms that the county deeded all of its rights away in the disputed road.

 

11:40 am Rockwell moves to pay the CEDA dues. Brandt seconds. Motion carries with Rockwell and Brandt in favor. Chmelik absent.

 

11:45 a.m. Rockwell moves to go into Indigent proceedings pursuant to Idaho Code 31-874. Chmelik seconds.  Roll call-District 1-yes, District 2-yes, District 3-absent.

Brandt moves to approve minutes from October 14th as amended by Rockwell. Rockwell Seconds. Motion carries with Brandt and Rockwell in favor. Chmelik absent.
